{"id":2939,"date":"2022-04-22T07:55:10","date_gmt":"2022-04-22T07:55:10","guid":{"rendered":"https:\/\/victorvillarabogados.com\/?p=2939"},"modified":"2025-01-14T22:11:36","modified_gmt":"2025-01-14T22:11:36","slug":"prohibicion-de-despedir","status":"publish","type":"post","link":"https:\/\/victorvillarabogados.com\/en\/prohibicion-de-despedir","title":{"rendered":"\u00bfVuelven a estar prohibidos los despidos?"},"content":{"rendered":"<p style=\"text-align: justify;\">El <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2022-4972\">Real Decreto-ley 6\/2022<\/a>, por el que se adoptan medidas urgentes en el marco del Plan Nacional de respuesta a las consecuencias econ\u00f3micas y sociales de la guerra en Ucrania adopta, en su art\u00edculo 44, que lleva por nombre <em>\u201cmedidas en el \u00e1mbito laboral\u201d<\/em>, dentro de <em>\u201cotras medidas de apoyo a trabajadores y colectivos vulnerables\u201d <\/em>una referencia a las causas de despido, que coloquialmente se ha venido denominando como<em> \u201cprohibici\u00f3n de despedir\u201d, <\/em>hasta, en principio, el 30 de Junio de 2022.<\/p>\n<p style=\"text-align: justify;\">Dicho art\u00edculo tiene la finalidad de, se dice en la norma, evitar despidos y proteger puestos de trabajo para garantizar la protecci\u00f3n social.<\/p>\n<p style=\"text-align: justify;\">Sin embargo, los \u00fanicos supuestos en que aplicar\u00eda ese supuesta protecci\u00f3n social ser\u00edan solamente dos:<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>Para trabajadores de empresas beneficiarias de ayudas directas de las previstas en el propio Real-Decreto ley,<\/strong> en tanto que las empresas no podr\u00e1n justificar despidos objetivos basados en la causa del aumento de los costes energ\u00e9ticos, siendo que en caso de incumplir la empresa lo dicho, ser\u00eda sancionada con la obligaci\u00f3n de devolver la ayuda recibida.<\/li>\n<li><strong>Para trabajadores de empresas beneficiarias de apoyo p\u00fablico y que se acojan a reducciones de jornada o suspensiones de los contratos (ERTEs) del art\u00edculo 47 del Estatuto de los trabajadores<\/strong>, por causas relacionadas con la invasi\u00f3n de Ucrania, en tanto que las empresas tampoco podr\u00e1n utilizar estas causas para realizar despidos.<\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong>\u00bfEs la primera vez que se adopta una medida similar?<\/strong><\/p>\n<p style=\"text-align: justify;\">No es la primera vez que se toma una medida parecida.<\/p>\n<p style=\"text-align: justify;\">Fue pionero el <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2020-4152\">Real Decreto-ley 9\/2020<\/a>, que en plena crisis del COVID-19 y en su art\u00edculo 2, plante\u00f3 que la fuerza mayor y las causas econ\u00f3micas, t\u00e9cnicas, organizativas y de producci\u00f3n que serv\u00edan para la justificaci\u00f3n de los ERTES, no ser\u00edan causas justificativas del despido o de la extinci\u00f3n del contrato de trabajo.\u00a0<\/p>\n<p style=\"text-align: justify;\">No obstante, ya se hab\u00eda incluido entonces en el Real Decreto-ley 8\/2020 una cl\u00e1usula de salvaguarda del empleo en la DA6\u00aa de la norma, medida m\u00e1s protectora que la actual, por la que las empresas deb\u00edan adem\u00e1s garantizar 6 meses de mantenimiento del empleo desde la reanudaci\u00f3n de la actividad tras los ERTES, so pena de devoluci\u00f3n por la empresa de las exoneraciones en las cotizaciones a la Seguridad Social de las que se hubiera beneficiado.<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: center;\"><strong>\u00bfEntonces, est\u00e1 prohibido despedir?<\/strong><\/p>\n<p style=\"text-align: justify;\">La respuesta es negativa.<\/p>\n<p style=\"text-align: justify;\">Evidentemente, <strong>nunca ha estado prohibido despedir<\/strong> en tanto que siempre se ha podido despedir, como es natural, disciplinariamente, por faltas del trabajador que impliquen tal sanci\u00f3n as\u00ed como determinados despidos objetivos tambi\u00e9n han podido realizarse sin restricci\u00f3n. Recordemos que los despidos objetivos resultan m\u00e1s <em>\u201cecon\u00f3micos\u201d<\/em> para las empresas en tanto que conceden una indemnizaci\u00f3n de 20 d\u00edas de salario por a\u00f1o trabajado frente a los 33\/45 d\u00edas por a\u00f1o trabajado de los despidos improcedentes.<\/p>\n<p style=\"text-align: justify;\">Ahora bien, la revisi\u00f3n de la calificaci\u00f3n del despido siempre es realizada <em>a posteriori<\/em> por la Jurisdicci\u00f3n Social, en cuyo caso, es el Juez qui\u00e9n declara la procedencia o justificaci\u00f3n del despido o su improcedencia o, incluso, su nulidad.<\/p>\n<p style=\"text-align: justify;\">Y es por ello que respecto al nuevo RD-Ley 6\/2022, la norma nos indica que <strong>no se entender\u00e1n justificados los despidos que se pretendan objetivos si se basan en el aumento de los costes energ\u00e9ticos, siempre y cuando la empresa haya percibido las ayudas descritas<\/strong>, ayudas que adem\u00e1s, deber\u00e1 devolver. Por consiguiente, caso de ser este el supuesto y la empresa pretender acreditar un despido objetivo, la consecuencia deber\u00eda ser la declaraci\u00f3n judicial de no ratificaci\u00f3n del mismo como despido objetivo.<\/p>\n<p style=\"text-align: justify;\">Asimismo, la norma nos indica que l<strong>as empresas que se acojan a ayudas p\u00fablicas y a suspensiones o reducciones de jornada (ERTEs), si intentan acreditar despidos mediante causas que tengan relaci\u00f3n con la invasi\u00f3n en Ucrania, tampoco se considerar\u00e1n justificados<\/strong> y, en consecuencia, el resultado deber\u00eda ser el mismo, la declaraci\u00f3n judicial de no procedencia o justificaci\u00f3n del despido.<\/p>\n<p style=\"text-align: justify;\">En consecuencia, el resumen resultante ser\u00eda que no existe prohibici\u00f3n de despedir y que <strong>solamente aquellos despidos en empresas que hayan solicitado determinadas ayudas p\u00fablicas no podr\u00e1n ampararse en las causas mencionadas.<\/strong><\/p>\n<p style=\"text-align: justify;\">Desgraciadamente, volvemos a estar frente a una normativa muy ambiguay con poco detalle de qu\u00e9 determinados supuestos deben aplicarse, qu\u00e9 concretas causas pasan a estar injustificadas, qu\u00e9 temporalidad y qu\u00e9 concretas consecuencias supone el incumplimiento.
