{"id":2948,"date":"2022-04-22T08:04:01","date_gmt":"2022-04-22T08:04:01","guid":{"rendered":"https:\/\/victorvillarabogados.com\/?p=2948"},"modified":"2025-01-14T22:08:57","modified_gmt":"2025-01-14T22:08:57","slug":"subida-smi","status":"publish","type":"post","link":"https:\/\/victorvillarabogados.com\/en\/subida-smi","title":{"rendered":"Subidas del Salario M\u00ednimo: \u00bfc\u00f3mo se aplican?"},"content":{"rendered":"\n<p style=\"text-align: justify;\">Las recientes subidas del <b>Salario M\u00ednimo Interprofesional (SMI)<\/b> han dado pie a cierta controversia al respecto de si deb\u00edan aplicarse en conjunto respecto de la retribuci\u00f3n anual o bien, \u00fanicamente respond\u00edan al concepto de <b><i>\u201csalario base\u201d<\/i><\/b>, debiendo por tanto ese salario base igualarse al SMI independientemente de que existieran otros conceptos salariales por medio de los cuales la retribuci\u00f3n anual del trabajador fuera superior al SMI anual.<\/p>\n<p style=\"text-align: justify;\">En otras palabras, <b>la cuesti\u00f3n a dilucidar es si la subida del SMI deb\u00eda necesariamente aplicarse a cualquier trabajador cuyo salario base fuera inferior a la actualizaci\u00f3n o bien se pod\u00eda compensar dicha subida con otros conceptos salariales,<\/b> resultando que para el caso de que el salario anual del trabajador, por suma de todos los conceptos, fuera superior al SMI anual, tal subida del SMI no tendr\u00eda afectaci\u00f3n en el empleado.<\/p>\n<p style=\"text-align: justify;\">Pues bien, tres recientes sentencias del Tribunal Supremo han aportado luz a dicha discusi\u00f3n jur\u00eddica: la <b>STS 292\/2022, <\/b>de 22 de Enero de 2022 (rec. 89\/2020), la <b>STS 1353\/2022, <\/b>de 29 de Marzo de 2022 (rec. 162\/2019) y la <b>STS 1355\/2022, <\/b>de 1 de Abril de 2022 (rec. 60\/2020).<\/p>\n<p style=\"text-align: justify;\">El resultado de las mismas, a grandes rasgos, es el criterio consistente en que l<b>os complementos salariales (conceptos variables y complemento por antig\u00fcedad inclu\u00eddos) deben computarse para comparar la remuneraci\u00f3n anual con la del SMI anual, y sin computar y excluyendo los complementos extrasalariales.<\/b><\/p>\n<p style=\"text-align: center;\"><b>\u00bfEn qu\u00e9 criterios se basa el Tribunal Supremo?<\/b><\/p>\n<p style=\"text-align: justify;\">El Tribunal Supremo realiza la interpretaci\u00f3n de la subida del SMI de 2019 (900 euros en 14 pagas; 12.600 euros anuales) introducida por el Decreto 1462\/2018, siendo que en el Convenio Colectivo de aplicaci\u00f3n, la retribuci\u00f3n se divid\u00eda en dos conceptos (salario base equivalente al SMI del a\u00f1o 2016, momento de firma del convenio y plus de antig\u00fcedad (trienios). As\u00ed, las organizaciones sindicales recurrentes defienden la necesidad de igualar el concepto de salario base de 2016 y actualizarlo al valor del SMI del a\u00f1o 2019 mientras que la Asociaci\u00f3n empresarial recurrida se aferra a la suma de ambos conceptos para comparar dicho valor con el del SMI del a\u00f1o 2019 y proceder a su equiparaci\u00f3n en caso de que fuera inferior, absorbiendo la subida del SMI, por tanto, con el plus de antig\u00fcedad o trienios.<\/p>\n<p style=\"text-align: justify;\">Sostiene el Tribunal que, de no ser as\u00ed, se vulnerar\u00eda el derecho a la negociaci\u00f3n colectiva<span class=\"Apple-converted-space\">\u00a0 <\/span>en tanto que: <i>\u201cla revisi\u00f3n del SMI tendr\u00eda un efecto multiplicador sobre todos los convenios colectivos, cuyos salarios bases fueran inferiores al SMI, que se convertir\u00eda, de este modo, en salario base, o salario fijo por unidad de tiempo para todos los trabajadores, cuyos salarios base convenio o pactados contractualmente fueran inferiores al SMI de cada a\u00f1o[\u2026] puesto que ser\u00eda el Gobierno, quien decidir\u00eda, a la postre, el importe de los salarios base o por unidad de tiempo, al margen delo pactado en convenios colectivos o contratos de trabajo.\u201d<\/i><\/p>\n<p style=\"text-align: justify;\">Asimismo, conviene que es clara la interpretaci\u00f3n de la norma en tanto que su objetivo no es otro que: <i>\u201cestablecer una garant\u00eda salarial m\u00ednima de los trabajadores por cuenta ajena, quienes tienen derecho a percibir <\/i><i>en c\u00f3mputo anual, por todos los conceptos<\/i><i>, la cantidad de 12.600 euros\u201d.<\/i><\/p>\n<p style=\"text-align: justify;\">Y, finamente, realiza una alusi\u00f3n al Convenio Colectivo de aplicaci\u00f3n para destacar lo paccionado en el mismo respecto de la compensaci\u00f3n y absorci\u00f3n de salarios siendo que el Convenio (Convenio Colectivo del sector de talleres para personas con discapacidad intelectual de Catalu\u00f1a): <i>\u201cno proh\u00edbe la compensaci\u00f3n y absorci\u00f3n de los incrementos del SMI, puesto que su simple lectura permite concluir que afecta \u00fanicamente a las revalorizaciones del propio convenio colectivo.\u201d<\/i><\/p>\n<p style=\"text-align: justify;\">Dichas Sentencias acude finalmente al contenido del art\u00edculo 27.1 del <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11430\">Estatuto de los Trabajadores<\/a> respecto de la no afectaci\u00f3n de la estructura del salario pese a variaciones en el SMI aludiendo que: <i>\u201cno cabe, tampoco, neutralizar, a estos efectos, lo percibido por trienios por cuanto que el \u00faltimo p\u00e1rrafo del art\u00edculo 27.1 ET incluye todos los salarios en su conjunto y c\u00f3mputo anual, sin realizar distinci\u00f3n alguna entre ellos sobre la base de la naturaleza homog\u00e9nea o heterog\u00e9nea de algunos de sus complementos, de manera que, solo cabe bloquear la compensaci\u00f3n y absorci\u00f3n por heterogeneidad de los conceptos salariales, cuando se haya convenido as\u00ed en el Convenio Colectivo\u201d.<\/i><\/p>\n<p style=\"text-align: justify;\">A mayor abundamiento, determinan que: <em>\u00abEl art\u00edculo 27.1 in fine ET es taxativo cuando prescribe que la revisi\u00f3n del SMI no debe repercutir sobre los salarios que viniesen percibiendo quienes, por tal concepto y en c\u00f3mputo anual, ya obtienen ingresos superiores\u00bb<\/em><\/p>\n<p style=\"text-align: justify;\">Y respecto de los conceptos extrasalariales o compensatorios, afirman las sentencias que: <em>\u00abla absorci\u00f3n y compensaci\u00f3n no rige cuando uno de los conceptos retributivos que interviene en la operaci\u00f3n no es absorbible por su propia naturaleza, cual ocurre cuando se trata de un complemento no salarial [&#8230;] la premisa car\u00e1cter extrasalarial del controvertido plus transporte no cabe dada que su compensaci\u00f3n y absorci\u00f3n con el salario base resulta irregular e il\u00edcita por cuanto que se produce entre conceptos no homog\u00e9neos, tal como reiteradamente ha declarado esta Sala\u00bb.<\/em><\/p>\n<p style=\"text-align: center;\"><b>\u00bfCu\u00e1l es entonces la conclusi\u00f3n?<\/b><\/p>\n<p style=\"text-align: justify;\">As\u00ed las cosas, podemos concluir que la si remuneraci\u00f3n anual del trabajador es igual o superior al SMI anual, se compensar\u00eda la subida y, por consiguiente, no habr\u00eda aumento en el salario percibido por el trabajador mientras que, en caso contrario, si operar\u00eda la subida del SMI.<\/p>\n<p style=\"text-align: center;\"><b>\u00bfC\u00f3mo ha ido cambiando el SMI desde 2016?<\/b><\/p>\n<p style=\"text-align: justify;\">A continuaci\u00f3n exponemos el aumento del SMI desde el a\u00f1o 2016, donde se situaba en 655,20 euros en 14 pagas (9.172,80 euros anuales) hasta el actual SMI del a\u00f1o 2022, fijado en 1.000 euros en 14 pagas (14.000 euros anuales).<\/p>\n<p>\u00a0<\/p>\n\n\n\n<div class=\"wp-block-columns alignwide is-layout-flex wp-container-core-columns-is-layout-1 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td><\/td><td><strong>SMI 14
