{"id":3173,"date":"2022-04-23T18:54:58","date_gmt":"2022-04-23T18:54:58","guid":{"rendered":"https:\/\/victorvillarabogados.com\/?p=3173"},"modified":"2025-01-14T22:06:45","modified_gmt":"2025-01-14T22:06:45","slug":"sube-renta-alquiler","status":"publish","type":"post","link":"https:\/\/victorvillarabogados.com\/en\/sube-renta-alquiler","title":{"rendered":"Alquiler de vivienda: \u00bfsube la renta un 2%?"},"content":{"rendered":"<p class=\"has-text-align-left\" style=\"text-align: justify;\">El alquiler de vivienda sube como m\u00e1ximoun 2% la renta. Como medida excepcional y para impedir que se pueda repercutir en el alquiler de vivienda los desorbitados niveles de inflaci\u00f3n actuales y el encarecimiento en todos los \u00e1mbitos de la vida, el Real Decreto-ley 6\/2022, por el que se adoptan medidas urgentes en el marco del Plan Nacional de respuesta a las consecuencias econ\u00f3micas y sociales de la guerra en Ucrania adopta en su art\u00edculo 46 una <em>\u201climitaci\u00f3n extraordinaria de la actualizaci\u00f3n anual de la renta de los contratos de arrendamiento de vivienda\u201d.<\/em><\/p>\n<p style=\"text-align: justify;\">Dicha limitaci\u00f3n afecta a contratos sujetos a la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1994-26003\">Ley 29\/1994, de Arrendamientos Urbanos<\/a> cuya renta deba actualizarse entre el 01 de Abril de 2022 y el 30 de Junio de 2022 e invita a las partes (arrendador y arrendatario) a negociar las condiciones de actualizaci\u00f3n diferenciando si el arrendador es o no\u00a0<em>\u201cgran tenedor de inmuebles\u201d<\/em>.<\/p>\n<p style=\"text-align: center;\"><strong>\u00bfY qu\u00e9 se entiende por \u201c<em>gran tenedor\u201d<\/em>\u00a0?<\/strong><\/p>\n<p style=\"text-align: justify;\">El propio art\u00edculo nos define la figura de gran tenedor para este supuesto\u00a0<em>\u201ca la persona f\u00edsica o jur\u00eddica que sea titular de m\u00e1s de diez inmuebles urbanos de uso residencial o una superficie construida de m\u00e1s de 1.500 m2 de uso residencial, excluyendo en todo caso garajes y trasteros\u201d<\/em>.<\/p>\n<p style=\"text-align: center;\"><strong>As\u00ed, las limitaciones a actualizar la renta son las siguientes:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>En caso de llegar a un acuerdo:<\/strong>\u00a0El incremento de la renta ser\u00e1 el resultado del pacto entre las partes si bien si el arrendador es gran tenedor se establece como norma imperativa que el valor de la variaci\u00f3n anual acordada no puede exceder el resultado de aplicar la variaci\u00f3n anual del \u00cdndice de Garant\u00eda de Competitividad a fecha de dicha actualizaci\u00f3n.<\/li>\n<li><strong>En caso de\u00a0<span style=\"text-decoration: underline;\">no<\/span>\u00a0llegar a un acuerdo<\/strong>:\u00a0Tanto si el arrendador es o no gran tenedor, no se podr\u00e1 aplicar un incremento superior a la variaci\u00f3n anual del \u00cdndice de Garant\u00eda de Competitividad (IGC) a la fecha de la actualizaci\u00f3n. Se toma como mes de referencia el \u00faltimo \u00edndice publicado (seg\u00fan el INE: Instituto Nacional de Estad\u00edstica) en la fecha en que proceda la actualizaci\u00f3n.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Es decir, en general no puede actualizarse la renta a niveles superiores a la variaci\u00f3n anual del \u00cdndice de Garant\u00eda de Competitividad (IGC), salvo que el arrendador no sea gran tenedor y las partes acuerden una actualizaci\u00f3n mayor.<\/p>\n<p style=\"text-align: justify;\">Y, en este \u00faltimo caso y siempre y cuando se hubiera pactado expresamente en el contrato, la actualizaci\u00f3n conforme al \u00cdndice de Precios al Consumo (IPC), debemos recordar que el nuevo acuerdo de actualizaci\u00f3n nunca podr\u00eda superar la variaci\u00f3n interanual del \u00faltimo \u00edndice publicado a fecha de actualizaci\u00f3n del \u00cdndice de Precios al Consumo (IPC). As\u00ed lo proh\u00edbe el art\u00edculo 18 de la Ley 29\/1994, de Arrendamientos Urbanos, para contratos celebrados a partir del 05 de Marzo de 2019.<\/p>\n<p style=\"text-align: center;\"><strong>\u00bfY qu\u00e9 valores presentan actualmente el \u00cdndice de Garant\u00eda de Competitividad (IGC) y el \u00cdndice de Precios al Consumo (IPC)?<\/strong><\/p>\n<p style=\"text-align: justify;\">El \u00faltimo dato vigente a 01 de Abril de 2022 del IGR publicado oficialmente en el INE es el relativo a la variaci\u00f3n anual de Enero de 2021 a Enero de 2022 y equivale a un aumento del +2,02%.<\/p>\n<p style=\"text-align: justify;\">Respecto del IPC, el \u00faltimo valor publicado a fecha de 01 de Abril de 2022 es el relativo a Febrero de 2022 y\u00a0equivale a un aumento del +7,6%.<\/p>\n\n\n<p><\/p>\n\n\n\n\n\n<div class=\"wp-block-columns alignfull is-layout-flex wp-container-core-columns-is-layout-1 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<div class=\"inherit-container-width wp-block-group alignfull has-text-color has-background is-layout-constrained wp-block-group-is-layout-constrained\" style=\"color:#000000;background-color:#ffffff\">\n<div style=\"height:22px\" aria-hidden=\"true\"
