Y, \u00bfcu\u00e1l es su verdadero contenido? \u00bfEs el SMI inembargable en su totalidad?<\/p>\n<p style=\"text-align: justify;\">Pues s\u00ed, tal prohibici\u00f3n de embargo procede del art\u00edculo <strong>27.2 del<a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11430\"> Estatuto de los Trabajadores<\/a><\/strong> (RDL 2\/2015, de 23 de Octubre y dice as\u00ed:<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\"><em>\u201cEl salario m\u00ednimo interprofesional, en su cuant\u00eda, tanto anual como mensual, es inembargable. A efectos de determinar lo anterior se tendr\u00e1n en cuenta tanto el periodo de devengo como la forma de c\u00f3mputo, se incluya o no el prorrateo de las pagas extraordinarias, garantiz\u00e1ndose la inembargabilidad de la cuant\u00eda que resulte en cada caso. En particular, si junto con el salario mensual se percibiese una gratificaci\u00f3n o paga extraordinaria, el l\u00edmite de inembargabilidad estar\u00e1 constituido por el doble del importe del salario m\u00ednimo interprofesional mensual y en el caso de que en el salario mensual percibido estuviera incluida la parte proporcional de las pagas o gratificaciones extraordinarias, el l\u00edmite de inembargabilidad estar\u00e1 constituido por el importe del salario m\u00ednimo interprofesional en c\u00f3mputo anual prorrateado entre doce meses\u201d.<\/em><\/p>\n<p style=\"text-align: center;\"><strong><em>Pero, \u00bfsolo es inembargable el salario m\u00ednimo interprofesional?<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>La respuesta es negativa<\/strong>. No solo el primer salario m\u00ednimo interprofesional es inembargable o, si se prefiere, embargable al 0%, sino que el resto de cuant\u00edas percibidas como salarios dentro de los rendimientos del trabajo tambi\u00e9n adquieren cierto privilegio legal por parte del deudor.<\/p>\n<p style=\"text-align: justify;\">As\u00ed, para las deudas civiles, el <strong>art\u00edculo 607 de la LEC<\/strong> (<a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2000-323\">Ley 1\/2000, de 7 de Enero, de Enjuiciamiento Civil<\/a>) nos reitera en su punto 1. Lo antedicho respecto del salario m\u00ednimo interprofesional o primer salario m\u00ednimo:<em> \u201cEs inembargable el salario, sueldo, pensi\u00f3n, retribuci\u00f3n o su equivalente, que no exceda de la cuant\u00eda se\u00f1alada para el salario m\u00ednimo interprofesional\u201d,<\/em> si bien en su punto segundo nos detalla que para los importes siguientes al salario m\u00ednimo interprofesional o, si se prefiere, segundos, terceros y sucesivos salarios m\u00ednimos interprofesionales las siguientes condiciones de embargabilidad:<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><em>\u201c<strong>2.<\/strong> Los salarios, sueldos, jornales, retribuciones o pensiones que sean superiores al salario m\u00ednimo interprofesional se embargar\u00e1n conforme a esta escala:<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em><strong>1.\u00ba<\/strong> Para la primera cuant\u00eda adicional hasta la que suponga el importe del doble del salario m\u00ednimo interprofesional, el 30 por 100.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em><strong>2.\u00ba<\/strong> Para la cuant\u00eda adicional hasta el importe equivalente a un tercer salario m\u00ednimo interprofesional, el 50 por 100.<\/em><\/p>\n<p style=\"text-align: justify; padding-left: 40px;\"><em><strong>3.\u00ba<\/strong> Para la cuant\u00eda adicional hasta el importe equivalente a un cuarto salario m\u00ednimo interprofesional, el 60 por 100.<\/em><\/p>\n<p style=\"padding-left: 40px;\"><em><strong>4.\u00ba<\/strong> Para la cuant\u00eda adicional hasta el importe equivalente a un quinto salario m\u00ednimo interprofesional, el 75 por 100.<\/em><\/p>\n<p style=\"text-align: justify; padding-left: 40px;\"><em><strong>5.\u00ba<\/strong> Para cualquier cantidad que exceda de la anterior cuant\u00eda, el 90 por 100.\u201d<\/em><\/p>\n<p style=\"text-align: justify;\">Dichos salarios <strong>deben calcularse en importes l\u00edquidos (no brutos)<\/strong> toda vez aplicadas las retenciones de Seguridad Social y tributarias pertinentes. Es decir, dichas cantidades se aplican a los importes que el trabajador en este caso vendr\u00eda a percibir en su cuenta corriente de forma directa y no al importe bruto antes de practicar las deducciones.<\/p>\n<p style=\"text-align: justify;\">Por otra parte, respecto de las pagas extraordinarias, tambi\u00e9n salario, la normativa claramente establece que en caso de ser prorrateadas, <strong>se aplicar\u00e1 como salario m\u00ednimo interprofesional el salario m\u00ednimo anual dividido entre 12 pagas<\/strong> o, para el caso de que no fueran prorrateadas, aquellos meses en que se reciba gratificaci\u00f3n extraordinaria se aplicar\u00e1 el doble del salario m\u00ednimo interprofesional mensual como inembargable para esa sola mensualidad.<\/p>\n<p style=\"text-align: justify;\">As\u00ed, conforme lo anterior y conociendo los <strong>importes actuales para el a\u00f1o 2023 respecto del Salario M\u00ednimo Interprofesional<\/strong> podemos anticipar los siguientes importes de embargo en salarios l\u00edquidos seg\u00fan la siguiente tabla:<\/p>\n<p>\u00a0<\/p>\n<table style=\"border-collapse: collapse; Deja a disposici\u00f3n del Letrado de la Administraci\u00f3n de Justicia <strong>rebajar entre un 10-15% los porcentajes establecidos<\/strong> respecto de los salarios m\u00ednimos 2\u00ba a 5\u00ba, con justificaci\u00f3n en las cargas familiares del deudor que sea objeto de la ejecuci\u00f3n y embargos.<\/p>\n<p style=\"text-align: justify;\">Ello no obstante, encuentra la presente inembargabilidad una <strong>excepci\u00f3n, prevista en el art\u00edculo 608 de la LEC<\/strong> mediante el cual, cuando se proceda a la ejecuci\u00f3n de una Sentencia que condene al <strong>pago de alimentos<\/strong>, dejando al juzgador la decisi\u00f3n de la cantidad que puede ser embargada pero que, sin duda, no resulta sujeta a la inembargabilidad anterior.<\/p>\n<p style=\"text-align: center;\"><strong><em>Ahora bien, \u00bftodos los conceptos de la n\u00f3mina son inembargables seg\u00fan lo dicho?<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">La respuesta vuelve a ser de signo negativo. Cuando hablamos de salarios hablamos de <strong>conceptos de naturaleza salarial<\/strong> (tanto salario base como pagas extraordinarias) pero no se incluyen como tan conceptos extrasalariales o compensatorios.
