{"id":3543,"date":"2025-02-01T07:46:00","date_gmt":"2025-02-01T07:46:00","guid":{"rendered":"https:\/\/victorvillarabogados.com\/?p=3543"},"modified":"2025-02-01T16:27:28","modified_gmt":"2025-02-01T16:27:28","slug":"prorroga-de-medidas-en-vivienda-por-el-decreto-omnibus","status":"publish","type":"post","link":"https:\/\/victorvillarabogados.com\/en\/prorroga-de-medidas-en-vivienda-por-el-decreto-omnibus","title":{"rendered":"Pr\u00f3rroga de medidas en vivienda por el Decreto \u00d3mnibus 1\/2025."},"content":{"rendered":"<h1 class=\"wp-block-heading\" id=\"prorroga-de-medidas-en-vivienda-por-el-decreto-omnibus-12025\">Pr\u00f3rroga de medidas en vivienda por el Decreto \u00d3mnibus 1\/2025.<\/h1>\n\n\n<p style=\"text-align: justify;\"><b>El <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2025-1560\">Real Decreto Ley 1\/2025 (Decreto \u00d3mnibus)<\/a> ha supuesto una pr\u00f3rroga de medidas en materia de vivienda <\/b>que ya ven\u00edan aplic\u00e1ndose.<\/p>\n<p>A pesar de que dicha normativa fue originariamente prevista a raz\u00f3n de la pandemia del COVID-19, las medidas <strong>se prorrogar\u00e1n hasta el 31 de Diciembre de 2025.<\/strong><\/p>\n<p style=\"text-align: justify;\">La normativa y medidas prorrogadas son los que siguen:<\/p>\n<ul>\n<li>\n<h6><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2020-4208&amp;tn=1&amp;p=20250129\">RDL 11\/2020, de medidas urgentes para hacer frente al COVID-19<\/a>:<\/h6>\n<ul>\n<li style=\"text-align: justify;\">Se prorrogan los supuestos del art\u00edculo 1 hasta el 31 de Diciembre de 2025: se mantiene el incidente de <strong>suspensi\u00f3n extraordinaria del desahucio<\/strong> por<strong> vulnerabilidad econ\u00f3mica <\/strong>y el test de vulnerabilidad arrendador-arrendatario.<\/li>\n<li style=\"text-align: justify;\">Lo mismo sucede con los supuestos del art\u00edculo 1 bis: el mantenimiento de la <strong>suspensi\u00f3n del procedimiento para arrendadores personas jur\u00eddicas o grandes tenedores<\/strong> con arrendatarios vulnerables o posesores vulnerables y dependientes.<\/li>\n<\/ul>\n<\/li>\n<li>\n<h6><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2023-12203&amp;tn=1&amp;p=20241224\">Ley 12\/2023, por el derecho a la vivienda<\/a>:<\/h6>\n<ul>\n<li style=\"text-align: justify;\">La referencia temporal de la Disposici\u00f3n Transitoria Tercera var\u00eda al 31 de Diciembre de 2025: la <strong>reanudaci\u00f3n<\/strong> de los procedimientos de desahucio de <strong>grandes tenedores<\/strong> se realizar\u00e1, en su d\u00eda, tras la acreditaci\u00f3n del <strong>procedimiento de mediaci\u00f3n\/conciliaci\u00f3n.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li>\n<h6><a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2020-16824\">RDL 37\/2020, de medidas urgentes en situaciones de vulnerabilidad en el \u00e1mbito de la vivienda<\/a>:<\/h6>\n<ul>\n<li style=\"text-align: justify;\">Los plazos de la Disposici\u00f3n Adicional Segunda ahora ser\u00e1n otros: la compensaci\u00f3n al arrendador por perjuicio econ\u00f3mico durante la suspensi\u00f3n abarcara hasta m\u00e1ximo el a\u00f1o 2025 y podr\u00e1 solicitarse hasta acabar Enero de 2026.<\/li>\n<\/ul>\n<\/li>\n<li>\n<h6><a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2021-9560\">RD 401\/2021, de compensaciones a propietarios y arrendadores<\/a>:<\/h6>\n<ul>\n<li>En l\u00ednea con lo anterior, la temporalidad del procedimiento del art\u00edculo 3 queda\u00a0 establecida hasta el 31 de Diciembre de 2025 y el 31 de Enero de 2026<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: center;\"><strong>\u00bfEl Decreto \u00d3mnibus ha supuesto alguna novedad en vivienda?<\/strong><\/p>\n<p style=\"text-align: justify;\">La respuesta es afirmativa. Ha iniciado el marco legal para establecer una <strong>\u00abl\u00ednea de avales\u00bb a cuenta del Estado en caso de impago de alquiler de vivienda.<\/strong><\/p>\n<p style=\"text-align: justify;\">Dichos avales ser\u00e1n gestionados por las Comunidades Aut\u00f3nomas pero con financiaci\u00f3n estatal y deber\u00e1n desarrollarse reglamentariamente en el plazo de 6 meses.<\/p>\n<p>Los avales cubrir\u00e1n:<\/p>\n<p style=\"padding-left: 40px;\"><strong>i) <\/strong>Todas las <strong>rentas impagadas.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>ii) <\/strong>Los<strong> da\u00f1os causados <\/strong>en el inmueble.<\/p>\n<p style=\"padding-left: 40px;\"><strong>iii) <\/strong>El coste de los <strong>suministros debidos.<\/strong><\/p>\n<p style=\"text-align: justify;\">Si bien el reglamento que en su d\u00eda se elabore podr\u00e1 matizar alguno de los aspectos generales, los requisitos para la obtenci\u00f3n del aval ser\u00e1n los que siguen:<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><strong>1. <\/strong>El <strong>inquilino<\/strong> deber\u00e1 ser <strong>menor de 35 a\u00f1os o ser una persona vulnerable<\/strong>.<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><strong>2.<\/strong> La <strong>renta<\/strong> del alquiler deber\u00e1 ser <strong>igual o inferior al \u00edndice estatal de referencia al alquiler<\/strong> para dicho inmueble.<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><strong>3.<\/strong> El <strong>arrendador<\/strong> deber\u00e1 haber <strong>depositado la fianza legal<\/strong> obligatoria (actualizada) conforme la Disposici\u00f3n Adicional Tercera de la<a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1994-26003\"> LAU.<\/a><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><strong>4.<\/strong> Las partes deber\u00e1n <strong>suscribir el compromiso relativo al aval del alquiler<\/strong> seg\u00fan el modelo que se apruebe administrativamente.<\/p>\n<p style=\"text-align: justify;\">En cualquier caso, dichos requisitos deber\u00e1n cumplirse tanto en el momento de perfeccionamiento del contrato como en el de la suscripci\u00f3n del aval.<\/p>\n<p style=\"text-align: justify;\">Por su parte, las solicitudes podr\u00e1n realizarse hasta 6 meses despu\u00e9s de recuperada la posesi\u00f3n de la vivienda por el leg\u00edtimo propietario.<\/p>\n\n\n\n<div class=\"wp-block-columns alignfull is-layout-flex wp-container-core-columns-is-layout-1 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<div class=\"inherit-container-width wp-block-group alignfull has-text-color has-background is-layout-constrained
