Efectivamente, los alquileres de renta antigua son una situación totalmente indeseable para los propietarios. Antes de plantear la venta del inmueble (que siempre es la última opción) podríamos analizar la situación familiar y patrimonial de su padre (propietario y arrendador del inmueble) así como la del inquilino, ya que existen algunos supuestos en la Ley de Arrendamientos Urbanos de 1964 que pueden dar lugar a la resolución del contrato del alquiler.

Son pocos supuestos, limitados y que tienen cierta complejidad llevarlos a término pero a priori es bastante probable que podamos evaluar alguna de esas opciones y que su familia recupere la posesión del piso para que no tenga que suponerle pérdidas y así puedan mantener el patrimonio familiar. Deberíamos estudiar el caso en concreto con más datos y plantear la estrategia a seguir.

Deberíamos saber qué tipo de arrendamiento es. Si es una vivienda la fianza legal está establecida en un mes, de forma obligatoria mientras que en el caso de un local de negocios la misma está establecida en dos mensualidades.

No obstante, también es lícito pactar una garantía complementaria, sin límites en el caso de locales de negocio y de máximo otras dos mensualidades en el caso de arrendamiento de vivienda.
