Las reclamaciones contra morosos en las Comunidades de Propietarios, por desgracia, son una constante. Por ello, la ley permite acceder a un procedimiento en teoría más veloz que el habitual por medio de la Demanda monitoria contra morosos en Propiedad Horizontal. No obstante, para interponer la misma correctamente es necesario el cumplimiento de una serie de requisitos (actas, notificaciones, certificaciones) que deben acompañar la Demanda para su buen fin. Por ello, habría que realizar una preparación del caso y, a la mayor brevedad, interponer dicha Demanda.

Dependiendo de los casos es posible realizarlo ante Notario. Asimismo, también es posible el divorcio en vía judicial pero de mutuo acuerdo, siempre y cuando ambos estén conformes y en los términos que pacten, que serían recogidos en un Convenio regulador que sencillamente sería ratificado por Su Señoría, el Juez sin más complejidad. En caso de no ser posible ambas alternativas, la única opción resultante sería el divorcio en vía contenciosa, pero es evitable y preferible y en múltiples casos posible, siempre que ambas partes tengan buena actitud y consigan llegar a un acuerdo.

A día de hoy la Ley de Arrendamientos Urbanos establece como período mínimo de alquiler para los arrendamientos de uso de vivienda, 5 años o 7 años según las circunstancias del arrendador. Por tanto, dicha cláusula que se les pide firmar sería nula por ir contra los derechos mínimos del arrendatario que están previstos en la ley.
